TestGrind Terms and Conditions of Use

TestGrind is an independent SAT preparation platform. TestGrind is not affiliated with, endorsed by, or sponsored by College Board.

These Terms govern your use of www.testgrind.com, related apps, account areas, content, and subscription services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy, Cookie Policy, and Conditions of Sale.

1. Operator and Legal Contact

The Service is operated under the TestGrind brand ("TestGrind", "we", "us", "our"). For legal notices and support: [email protected].

2. Service Scope

TestGrind provides digital SAT preparation tools, including practice questions, explanations, analytics, simulations, and progress tracking. The Service is educational support and does not guarantee a specific SAT score, admission result, scholarship, or academic outcome.

3. Eligibility and Minors

• You must be at least 13 years old to create or use an account.
• If you are under 18, you represent that a parent or legal guardian has authorized your use of the Service.
• You must provide accurate information and keep account credentials confidential.
• You are responsible for all activity under your account.

4. Accounts, Security, and Suspension

We may require verification, limit access, suspend, or terminate accounts to protect platform integrity, users, and legal compliance, including where we detect fraud, abuse, unauthorized access, or material violations of these Terms.

5. Free and Premium Features

The Service includes free and paid features. Feature availability, usage limits, and plan configurations may change for legal, operational, anti-abuse, or product reasons.

6. Acceptable Use Rules

You may not:

• copy, license, distribute, or resell Service content without written authorization;
• share accounts, bypass paywalls or usage limits, or evade anti-abuse controls;
• scrape, reverse engineer, decompile, automate, or interfere with the Service;
• manipulate scores, rankings, challenges, or analytics fraudulently;
• upload unlawful, harmful, infringing, or deceptive content.

7. Subscriptions, Billing, and Renewal

Paid subscriptions are billed via Stripe and renew automatically unless cancelled before the next billing date. By subscribing, you authorize recurring charges according to your selected plan until cancellation.

Billing details, cancellation effects, and refund terms are governed by the Conditions of Sale.

8. Intellectual Property

All platform elements (including software, design, question banks, analytics, branding, and educational materials) are owned by TestGrind or licensors and protected by intellectual property laws. You receive a limited, revocable, non-transferable, non-sublicensable, personal license for lawful, non-commercial use.

9. Third-Party Services

We rely on third-party providers (e.g., Stripe, Google services, YouTube). Their tools are governed by their own terms and policies. We are not responsible for third-party outages or policy changes outside our control.

10. Availability and Changes

The Service is provided on an "as available" basis. We may perform maintenance, deploy updates, change features, or discontinue components at any time. We do not guarantee uninterrupted availability.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, TestGrind will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of data, revenue, profits, or opportunity.

Where liability cannot be excluded, our aggregate liability for claims arising out of or related to the Service is limited to the amounts paid by you to TestGrind in the 12 months preceding the claim event.

13. Indemnity

You agree to defend, indemnify, and hold harmless TestGrind and its affiliates from claims, liabilities, damages, and costs (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms.

14. Privacy and Cookies

Processing of personal data is governed by our Privacy Policy. Cookie and consent handling is governed by our Cookie Policy.

15. Governing Law and Venue

These Terms are governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflict-of-law rules. Unless mandatory law provides otherwise, exclusive jurisdiction and venue lie in courts located in New York County, New York.

16. Changes to Terms

We may update these Terms for legal, regulatory, operational, or product reasons. The latest version and effective date are published on this page. Continued use after updates constitutes acceptance of the revised Terms.
